GAY RIGHTS
In New Jersey, workers have the right to be free from discrimination based on their sexual orientation.  This includes gay, lesbian, bisexual, transgendered and heterosexual people. 

Sometimes employers discriminate openly against gay and lesbian employees.  In other cases, discrimination may take the form of actions directed at an employee's gender identity or gender expression. 

It is important to recognize that sexual orientation discrimination can be a form of sexual harassment.  A sexually charged working environment can easily become a hostile working environment. 

New Jersey employees are protected by the New Jersey Law Against Discrimination (LAD).  The LAD allows an employee who has been the victim of discrimination based on her sexual orientation to sue for damages in court, including lost wages, emotional distress damages, punitive damages, and attorneys fees and costs.  New Jersey residents should also note that the LAD protects them from discrimination in non-employment situations, such as housing and when using places of public accommodation.

Employees working in New York City should also consult the New York City Human Rights Law, a powerful statute that protects against sexual orientation discrimination.  The law can be found here.
